Resident alleged FOIA requests denied

A case filed April 4, and alleging that Patrick County failed to comply with the Freedom of Information Act (FOIA), was continued last week in Patrick County general District Court, according to court documents.

Russell W. “Bill” Moore names Tom Rose as the respondent in the document, a Petition for Injunction or Mandamus – Freedom of Information Act and Affidavit for Good Cause or Protection.

According to Virginia law, and in cases involving a local public body, the petition can be filed with “the general district court or circuit court of the county or city from which the public body has been elected or appointed to serve and in which such rights and privileges were so denied.”

The document alleged that Rose, in his capacity as county manager, “has denied or caused to be denied my rights to public records within five days of the receipt of a FOIA request.”

It further stated that Moore received no response to “multiple requests for public records” regarding the 2016 Patrick County Audit.

Moore is asking for the public records he requested to be produced or the county show good cause why those records should not be made public.

Rose said Thursday “we feel like we have provided him adequate answers. We have tried to satisfy the questions to the best of our ability.”

The next court hearing on the matter is tentatively scheduled for April 25.
